Changes to Nationality Acquisition Process
As of March 5th, 2024, the Nationality Law has been updated with its tenth amendment (Organic Law No. 1/2024), as published in the Diário de República. These amendments will be effective as of April 1st, 2024.
Key Updates:
- When applying for Portuguese nationality, whether through investment routes such as the golden visa or other visa types like D2 or D7, it's crucial to note that the period considered will now include the time from when you initially requested your temporary residence permit.
- This means that the countdown towards the 5-year residency requirement for nationality applications begins not at the issuance date of your first residence permit, but from the date you applied for the permit.
Awaiting Further Clarification:
- The specifics of "the moment at which the temporary residence permit was requested" need further regulatory definition. This could mean either the date you submitted your residence authorization application or the date you paid the application fee.
Significance of the Amendment:
- This legislative change is a proactive move by the Portuguese State to address and mitigate the lengthy delays many have faced in the nationality process. It aims to allow prospective nationals to apply nearly two years earlier, offering a form of compensation for past delays.
